Video / Liberty – Amina Bouayach Issues the CNDH 2020 Report on the Situation of Human Rights in Morocco

The National Human Rights Council (CNDH) has published its annual report on the situation of human rights in Morocco for the year 2020, under the theme “Covid-19: an exceptional context that puts human rights into the test”.

This report was first presented by CNDH President, Amina Bouayach, during a press conference, held on Thursday, in Rabat, as it tended to analyse and assess the situation of human rights in Morocco during the new Covid-19 pandemic.

Within this text, CNDH presented all results relating to its activities and interventions in terms of protecting and promoting human rights, as well as ensuring the respect due to its humanitarian codes, by adopting an approach that takes into account the independent and pluralist nature of the council as an institution.

This 232-page report covers six main axes; namely:

– The legal framework governing the state of health emergency in relation to the Covid-19 pandemic.

– The human rights situation and the pandemic’s impact on related matters.

– Promotion of human rights.

– National cooperation relations.

– World-scale solidarity cooperation and relations, and monitoring the implementation of the IER recommendations.

The report also includes special recommendations relating to the protection and promotion of human rights during the pandemic, as well as various general recommendations aimed at developing human rights as a concept at the legal and institutional levels, besides other public policies and practices.

The council’s mechanistic reports have been included in full within CNDH’s annual report, in accordance with Article 20 of Law No. 76.15, relating to the reorganization of the Council. These reports cover the national mechanism for the prevention of torture, the national redress mechanism for victimized children, and the national mechanism for the protection of persons with disabilities.

This report tends to draw the attention of the government and Morocco’s public authorities to the possible human rights violations in our country, thus inviting these major forces to take part in the Kingdom’s national and international commitments with the purpose of promoting public policies through a human-rights-based approach.

Moreover, the recommendations stipulated within the report can be adopted by the parliament when harmonizing the national legislation with international standards, in addition to establishing some sort of governmental accountability.

The report also includes recommendations that take into account the Kingdom’s international human rights commitments, in light of the existing constitutional requirements that constitute a pledge for both rights and freedoms.

These recommendations are (of course) based on the strategic orientations adopted by the Council, the social debates initiated by the CNDH, the summaries of the regional meetings organized by the council, the recommendations that CNDH has formulated, and the practices that the latter has observed.

These structuring recommendations, addressed to the public authorities, relate to the kingdom’s conventional practices and their interaction with the international human rights system, in addition to the legal and institutional framework, as well as other public policies, programs and practices.
